I. General Terms

• Provide neat references.

• Please write in an understandable and polite manner.

• Minors are not allowed to request NSFW work.

• I have the right to decline your commission.

• You are NOT allowed to use my art for NFT's or for AI under ANY circumstance.

• I refuse to emulate another artist's style.

II. Payment

• PayPal ONLY.

• Payment only in Euro (€).

• You pay the conversion fee for other currencies so I still get the full price I am charging you for.

• If you want PayPal buyer-protection, you must carry the cost yourself and add it to the total you're paying me.
  -> To make sure I get the correct amount, please use THIS and make sure you select EUR (€).

• Edits after sketch is done will cost extra. Edits while in the sketching phase are free.

• The 50% paid upfront are non-refundable.

• If you require a payment plan, please consult me and make me aware of this.

III. Process

• Payment either 100% or 50% upfront.

• The time for your commission to be completed can be up to 2 months depending on many factors such as: Health, order of commission, complexity, work, family issues, etc.

• If any of the things stated above occur, you will be notified ASAP.

• During the process of me working on your art, I will check in regularly to make sure the art is fulfilling your expectations. If any issues arise or you want something to look different, please let me know as soon as possible to avoid issues down the line, and to prevent further costs for you.

• Once the artwork is done (and paid for), I will send you the picture as a .zip file to make sure it keeps its quality over any medium I send it through.

IV. Copyright/ Usage policy

• I, the artist, hold every right to the produced drawing, not the commissioner.

• Therefore, I am allowed to use the copyrighted artwork to: promote myself in any place or site, display it to my liking, post it wherever I want, publish books with it, etc.

The commissioner is allowed to:

• Use the copyrighted artwork for personal use only unless agreed otherwise, print the art, and claim the right to the character(s) but not the drawing itself, use the art to promote themselves with proper credit given to the artist.

• If you break the copyright in any way, every right you had to the drawing will be retracted.

The following is considered Copyright infringement:

• Reproducing/ using the copyrighted artwork commercially (meaning making money off of it in any way), taking credit for the creation of the artwork, removing any watermarks/ signatures, altering the artwork without my, the artists, consent.

• A purchase of commercial rights to the artwork will always be 200% of the original price.

• With commercial rights you are allowed to make any sort of merch from the artwork, use it in books, covers, as props, change it to your liking and promote your own brand with. Credit is still required for usage of the artwork, even if altered or edited.

• If you did not purchase commercial rights, the commissioned artwork is for personal use only, not for profit or merchandise.  Therefore you are NOT allowed to use my artwork as profile picture for any commercial sites (eg. Youtube, Twitch, etc.) without the purchase of commercial rights.

V. Canceling/ Refunding policy

• You have no right to cancel or demand a refund from the artist under any circumstances after payment is received.

• If money has not been sent yet the commissioner has the right to cancel the commission.

• If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.

• You will be forbidden to ever commission me, Xemoness, ever again.

• Your name will publicly posted wherever I want to for others to watch out for.

• I also have every right to file a complaint and I have all the right to the money you have given me for my work.

Any statement can be bound to change if discussed with me, the artist, prior to the commission.
