Terms of Service & more.

I. GENERAL TERMS

• Provide neat references. If unsure, refer to my guide on references. (It has a template if needed).

• Please write in an understandable and polite manner. English or German works.

• Minors are not allowed to request NSFW work.

• I have the right to decline your commission for any reason.

• You are NOT allowed to use my art for NFT's, AI or anything of the sort under ANY circumstance.

• You are not allowed to upload my NSFW work to Rule34, or any other site of the sort without prior permission.

• I will not emulate another artists' style.

• Commissioned art must not be used to promote bigotry, hatespeech or anything of the sort. If I find out you are using my art to promote such content, you will get blacklisted publicly and you will lose all rights to any work I have ever made for you.

• Blacklisted clients are not allowed to commission me again and will be posted publicly to make other artists aware.

• Depending on reason, blacklisted users will lose all rights to any work I have ever made for them.

II. PAYMENT/ REFUNDS, EDITS

​PAYMENT:

• PayPal ONLY, unless you commission me through another website (VGen, Kofi).

• Payment only in Euro (€).

• Payment either 100% or 50% upfront.

• You pay the conversion fee for other currencies so I still get the full price I am charging you for. (eg. 50EUR is 54,39USD)

• Only pay using the goods and services option (or via my invoice), otherwise I will refund.

• If you require a payment plan, please consult me and make me aware of this.

• NSFW is +20% of the calculated price, eg. if you want a shaded fullbody, add 20% of that to the final price. (eg. 75€ + 20% = 90€)​

REFUNDS:

• I will not offer refunds unless there has been 0 progress made on the piece for a considerable amount of time and I am unable to finish your work.

• Let me know before just doing a chargeback so we can talk about our options.

• Refunds will be 50% of the original price due to fees.

• If there is a file for refund/ chargeback without my consent you will get blacklisted immediately and you will lose all rights to any work I have ever made for you.

• If you have received artwork that meets the requirements you established in the beginning, reasons like "I do not like it anymore", "I don't vibe with it", or anything of the sort are not applicable to receive a refund.

EDITS:

• Edits after given the go-ahead for one step of the process (any artwork update I send that has gotten approved to be moved on from) cost extra.

• Edits while in the sketching phase are free within reason (eg. if the edits are requested in a timely manner, if the artwork is not near completion, if you've not approved them yet, etc.).

• Edit fees will vary depending on the time required to fulfill the request.

III. PERSONAL VS. COMMERCIAL USE

PERSONAL USE means:

• Using as your icon/ banner/ header online, with credit.​

• Using as your phone/ desktop background.

• Showing it off during a stream with credit, similar to showing off fanart, etc.

• Printing out 10 or less copies yourself to use as room decorations, postcards for friends, anything that doesn't involve money, etc. (Please contact me if you have questions about this.)

COMMERCIAL USE means:

• Using my art on thumbnails for streams, or to post on social media to advertise any streams, etc.

• Using  as emotes/ stickers on streams, etc.

• Using as a PNGtuber/Vtuber avatar.

• Using as your business logo. (Pricing can vary depending on the business size.)

• This includes printing it out to use on thank-you notes for small businesses.

• Using it on merchandise that you will sell, no matter the scale.

• Using the art to make money in any way.

IV. USE OF COMMISSIONED/ORDERED WORK

• Commissions are assumed to be for PERSONAL USE. Commercial use must be discussed.

• Personal use commissions will always include a watermark.

• Commissioned art cannot be used for NFTs, blockchain/cryptocurrency, AI training or anything of the sort. Breaking this will lead to you getting blacklisted immediately and losing all rights to any work I have ever made for you.

• Commissioned NSFW art shall not be uploaded to sites like Rule34 or similar without explicit permission beforehand.

V. COMMUNICATION

• I will mainly communicate through Discord (@xemoness), VGen chat or email (xemoness.commissions@gmail.com).

• Updates and waitlists are on my Trello.

VI. DELIVERY/ EDITING/ POSTING

• You are not allowed to edit my work. Please contact me if you need anything edited/ fixed. Any major edits done after I finish your commission will require a small fee that can be discussed.

• You are not allowed to remove any watermarks from any files I send you.

• I reserve the right to post your commission to my social media/portfolio, giving credit to you for the character (if applicable). Please let me know in advance if you don’t want it posted.

• You (the commissioner) can repost to other sites as long as you link back to my socials (Linktree, Twitter, Discord, my website, etc.). (@xemoness on all sites)

VII. DEADLINES/ RUSH ORDERS

• Commissions take around 1-2 months to complete, with a maximum of 3 months, if not more depending on the scale of the project. Rush orders will need an additional fee.

• I will always communicate updates about your commission as needed. However, please only ping me once a week at most.

• If there is an established deadline but the client does not respond in a timely manner (eg. for progress updates, edits, etc.), the deadline will be pushed back accordingly.

• If I’m already working on the commission and you realize you need it earlier than the estimated time, an additional fee will be added.

Any statement can be bound to change if discussed with me, the artist, prior to the commission.
